Definition Sale of Goods Act 1957 (SOGA)


The contract of sale of goods is governed by the Sale of Goods Act 1957 (hereinafter referred to as “SOGA”). The Act applies to contracts for the sale of all types of goods, including second-hand goods and makes no distinction between commercial sales. The SOGA applies to Peninsular Malaysia except Sabah and Sarawak. The law in these two states is governed by section 5 (c) of the Civil Law Act 1956. Under Section 4(1) of SOGA states a contract of sale of goods is a contract whereby the seller transfers or agrees to transfer the property in goods to the buyer for a price.

From the above definition, there are 3 main ingredients in a contract of sale of goods. Firstly, there must be goods which are to be transferred to the buyer. Secondly, the seller transfers or agrees to transfer the property in goods to the buyer. Lastly, there is a price for the said transfer. The objective of the contract of sale of goods is the transfer of ownership of the goods to the buyer for money consideration. Sale occurs when the ownership or property in goods passes to the buyer. According to section 2 defines buyer is a person who buys or agrees to buy goods meanwhile; seller is a person who sells or agrees to sell goods.

According the general rule, reliance on the seller’s skill and judgment states the buyer must establish that he had relied on the seller’s skill and judgment before purchasing the goods. Besides, the degree of reliance is a matter of reasonable inference from the circumstances of each case. That which is far from clear is the question of how far disclosure of the purpose for which goods are required will raise a presumption that reliance is being placed upon the seller’s skills and judgment.

Besides, the goods must not have been bought under patent or trade name. The proviso to section 16 (1) (a) states that ‘in the case of a contract for the sale of a specified article under its patent  or other  trade name there is no implied condition as to its fitness for any particular  purpose’. This has been interpreted to mean that if a buyer asks for specific goods under a patent or trade name with the impression that he is not relying on the seller’s skill or judgment, then he cannot later complain if the goods bought are not fit for the purpose which he requires them.

Relevant Case: Grant V Australian Knitting Mills

In this case, Mr. Grant bought some underwear made by Australian Knitting Mills (AKM) from a store in Adelaide.  Mr. G suffered dermatitis as a result of wearing the underwear.  It was later discovered that the condition was caused by an excessive use of chemicals in the manufacturing of the underwear. The court held that reliance usually arises by implication from the circumstances. For instance, of a purchase from a retailer the reliance will be inferred from the fact that a buyer goes to the shop in the confidence that the seller has selected his stock with skill and judgment.

Relevant Case: Baldry and Marshall

In this case, the buyer had asked the dealer for a car suitable for touring. The dealer recommended a Bugatti car. A contract for the sale of a Bugatti car was made. It was later found that the car was not suitable for touring. The court held that the dealer was liable because the buyer had relied on the dealer’s skill and judgment in the selection of a car suitable for the buyer’s stated purpose even though it was sold under a trade name.

Disadvantages of Economic Development


Economic development is a process of economic growth with an improvement in socio-economic and technological advancement. Economic growth refers to the continue increasing of Gross Domestic Products (GDP) or Gross National Products (GNP) or the ability of a country to produce more goods and services every year. There are 3 disadvantages of economic development such as social problems, pollution, and the existence of income gaps contributes.

Firstly, one of costs economic development is social problems. Social problem is a condition that at least some people in a community view as being undesirable. Every newspaper is filled with stories about undesirable social conditions. Examples include crime, violence, drug abuse, and environment problems. Such social problems can be found at the local, state, national and international levels. Basically, social problems effect of economic development through attitude of the citizen of the country toward the progress. The society actually represents as the value of achievement, personal gain and accumulation of wealth and things generally. In the case of social problems in Malaysia, this problem occurs due to the western culture influence. For instance, the build-up of the night club may affect the environment influence of Malaysia such as drug abuse, and the activity of prostitution. These will make the well-mannered and the custom of Malaysia will erode by this influence.


The next point is the pollution. Pollution is the addition to the ecosystem of something which has a detrimental effect on it. One of the most important causes of pollution is the high rate of energy usage by modern and growing population. Pollution has serious implications for economic growth and welfare because of its impact on health, resource depletion, and natural calamities linked to climate change. The manufacturer or company will emphasize of their profit by using of the new technology. But it is a make a higher cost to use on their operation. Therefore, they will cut down on their cost for buying the advancement of technology machine in their production. It will lead to them to ignore the environment. In the part of social welfare, the pollution will make the implications on society health. Besides, on the physical effects of pollution is the result of oil spills. The marine life such as fish and plankton will be destroyed by the pollution. In this case, the fisherman will loss of their income and the price of fishes will be increases due to the inflation.

Last but not least, the existence of income gaps contributes one of the costs economic developments. An income gap refers as the unequal distribution of household or individual income across the various participants in an economy. Economy inequality varies between societies, historical periods, economic structures, system of economic and between individuals’ abilities to create wealth. Such capitalism economy or known as laissez-faire, every individual in the country has a right to acquire private ownership of resources. Individuals can own the resources and they can accumulate property and use it as they choose.  In the economic developments, the income inequality will disappear when there are exists a group of people conquer the asset or equity. In addition, there are several reasons contributing to this situation and among others such as difference in human skills and ownership, difference access to capital, educational attainment and the employment pattern. In a nutshell, the rich become richer, the poor become poorer.

In this era of globalization, meeting persons from other countries happens often. It is called cross-cultural communication. Without proper understanding of it, misunderstandings can occur, especially in the workplace. Much care should we put forth when communicating with foreigners because we might offend them without intending to do so.

People who practice high-context communication do not explicitly say what they want to convey. They do this to preserve and strengthen relationships. Europeans, however, practice low-context communication. For them, the spoken word carries most of the meaning. The use of verbal message is explicit, while non-verbal elements, limited.

The French believe that as long as the person does a good job, then he or she is a good manager. They prefer to separate work and personal life. They believe that relationships do not have much effect on work. For them, people can work together without having good relationships.


Hence, without proper understanding of cross-cultural differences, a person will have problems communicating and interacting with another from a different background. In conclusion, we need to be culturally competent to interact globally.

All About The Grade




We all know that changing the education system is a long process. While this issue of grades plays out, what can parents and teachers do to minimise the potentially negative impact that grades have? Every parent wants to boast that his or her child on 'outstanding result' in examination instead of  straight 'A' student at all examination their children is taken. Most often, report cards are the primary means of measuring a child's progress through school. In school, the series of  how well the students are measured by the letters on a place on a piece of paper : A is great , B is ok, C is not so great. How about D, E and F? You're grounded!





Some parents reward children for good grades, ascribing a monetary value to each good letter, or taking away privilages for each bad one. For many families, the grade is the 'standard'. Why they are taking this step? Is it seems such a punishment towards their children? For me, absolutely YES!. The parents should give motivation and contenance to their children first before set up their own grades. A child will pleasantly to improve their effort without stress. How beautiful is that. No stress, No punishment, No heart feelings. Besides, they also keep focused on what they want to ACHIEVE.

Lastly, parents should minimise the significance of grades. The questions they ask their kids ought to be about what they are doing, not about how well the teacher thinks they are doing. Do not put on blame on your children, but keep motivate yourself first as parents ' what can I do for my kids'. Please, make a good and wise plan!

It is a big concerned for teenagers nowadays as they are unaware of the importance of English language as they tend to ignore to learn the language. Students’ attitude towards the language is also crucial to make sure that these teenagers can face the future world better by learning English language as it is an international language.
          
 Although the government has repeatedly told us of the importance of English, many students are still not bothered about studying it seriously. There is also a campaign that still on to make all the Malaysian becomes a better English learner, which is ‘Enhance Proficiency in Bahasa Malaysia, Strengthen the English’. English is the most important and the most useful language in the world today. There are many reasons why you should study the language properly.

 First and foremost, English will definitely help you a lot when you want to further studies. Almost all books at university are written in English in all subjects. Plus, it is a compulsory for any candidate to pass English with credit before entering any universities. So, if you are poor in English, you will blow you chance for better education or worse, you are going to have a big problem studying at university.



  The second reason why you have to study English well is that it will help you to get a job. When you go for a job interview, the interviewer will surely talk to you in English. The first impression you should give in order to success and have the job is, to respond in English fluently. Your chances of getting the job are very slim if you stutter while interviewing. A good command in of English will also help you greatly in your job. If the company you work is actively involved in international trade, you have to speak to prospective customers in English. Miscommunication might occur if your English is bad. And this will put your company at risk and you will likely be dismissed if this happen.  

 Good English will also help you a lot when you travel. Every country in the world studies English. Even the roadside stall-holders in China speak fairly good English! At least some of the people you meet on your travels in other countries can understand English. The language is certainly practical when you are lost in your trip. Communication problem will not happen if you can converse well in English. Inevitably, English is one of the languages used in any airport in the world in making announcement. Knowing English well, therefore, make travelling overseas easier.

Besides all these, entertainment is one of the major advantages you will experience if you good in English. You will enjoy television’s best programmes. We must admit that many of the best programmes are produced by the Americans and British companies. High self confidence influenced by the programmes will indirect inculcate in yourself when you are fluent in the language. Quality time is worthily spent if you understand and enjoy the programmes.

 Based from all the above elaboration, I hope that people will see the importance and realise how importance the language is for their own future. Although it is a second language in our country, it is now a main language all over the world.

Countryside VS. City

I think living in the countryside is far better than living in the city. There are numerous of reasons why living in countryside is the better than the city. The scenery, the streets, the people and the paced are totally different compare to the city.

The first outstanding characteristic about the countryside is that it is beautiful and peaceful. The air is fresh and the surroundings green. This is because the countryside is free from pollution, be it air, land or noise pollution. There no such perfect peaceful view that you can see other than in the countryside.
There are no crowded streets and heavy traffic in the countryside. Thus there are no fumes from cars and smoke from factories buildings to pollute the air. The trees surrounded the countryside help the people from inhaling the polluted air. The freshness smell of plant somehow helps the people of the countryside to have a healthy life.

Furthermore, people in the countryside are more conscious of keeping their surroundings clean and so there is little throwing of rubbish everywhere, only at designated places. This is unlike the cities where if the garbage trucks do not collect the rubbish disposed by household or restaurants, the city will be overflowing with rubbish! This will attract the mosquitoes, fly, rats and wild dogs to pollute their surrounding that will cause them to have diseases like dengue and cholera.

Thirdly, heavy traffic and crowded streets increase the level of noise pollution. The honking of cars in the streets is continuous and the crowds on the roads increase the hub of activity. There are also sound of the machine used in manufacturing factories, loud radio in and out the mall. These add to the noise of the city. Even if one lives in residential areas, one is never far from busy streets.However, in the countryside, life is slow-paced. There is no need to rush around because there are not too many places to go. Most places are close by and people can walk or cycle. Less vehicle used, so less fumes is released.

The most heart-warming thing about the countryside is the attitude of people. People are friendly and helpful. If there are any happy or festive occasions, everyone pitches in to help. This feeling of cooperation and neighbourliness is what separates the countryside from the city. In the city, people are too busy to take note of the people around. Some hardly even know their neighbours. So they would not even be bothered about what happens to people around. This is why the crime rate is increasing in the city because bystanders do not rush in to help if a crime is committed on the streets.


The pace of life in the countryside is slow so people have more time to enjoy life as the day goes on. Thus, for me to enjoy the quality of life, I prefer to live in the countryside.

Effect of Hiking Fuel Price to Society




Money is always an issue in today's era of materialism. Most people need it for basic survival while the lucky few indulge in luxuries without worrying about money. In my opinion, I strongly agree that the rising fuel price has pushed up the price of other consumer products and this will definitely affect the society. In this essay, I would like to touch on the effects this price increase has on society today, namely increasing vice activities, widening the gap between the rich and the poor and affecting the population trend in the long term.

               First and foremost, society will immediately be affected by the rise in fuel prices because consumer products will be more costly and this leads to an increase of vice activities. This is because basic necessities such as rice, flour, sugar and so on will be in great demand and some warehouses will store or hoard the items to further increase the price of the product. Moreover, in the newspapers today, reports of smuggling of these items prove that this vice activity is on the rise. For example, the recent sugar price hike caused a furor among the Malaysian society as it costs more fuel to travel to and from the supermarket and when arriving, most places had run out of stock even though the government had allocated 2kg of sugar to one person. Therefore, the fuel price increase had definitely caused more hardships to society today.

             Secondly, it is undeniable that the rise in fuel prices leads to the widening of the gap between the rich and the poor. This is due to the fact that people are greatly affected by the price of basic necessities such as food and fuel in particular. Furthermore, the rich people will still be able to afford such things but the poor will face greater challenges as the popular saying goes: "The rich get richer, and the poor get poorer." For instance, when money is used to purchase consumer products that are necessary for survival, then less money will be spent on health and dental check-up, educational purposes and others. Thus, it is clear that the fuel price hike will further stress on the differences between the rich and the poor which is such a tragedy.




                Last but not least, in the long term the population trend or demographics of the society will be greatly affected. This means that new families will consciously decide not to have too many children in order to increase their quality of life. In addition, society is now more aware of birth control and family planning so this will greatly reduce the population as most families will have 1 to 5 children instead of more. Take for example, new families with less children will surely spend less on basic necessities like food, clothes, transport and many more. Hence, the demographics of the whole country will be affected and this in turn will reduce our workforce which will affect our country's productivity and prosperity.


                 In short, there are many short term to long term effects of a fuel price increase which includes more crimes like hoarding and smuggling will occur and this leads to the widening of the gap between the rich and the poor as well as a change in the society's demographics. I still strongly believe that the rising fuel price has pushed up the price of other consumer products and this will surely cause a negative impact to society. The government must find a way to stabilise the fuel price at a reasonable rate so that it does not affect the productivity of this country towards achieving the aspirations of the nation for Vision 2020.


Stress Among University Student



Stress is a normal phenomenon in university life. It is an accepted fact that stress is a common problem for university students of different ages, disciplines of study, and social and economic backgrounds. Furthermore, research has shown that stress has negative impact and effects on an individual’s health and lifestyle. In view of these situations, it is essential and necessary for university students to know how they can mange stress effectively. In my opinion, there are three ways that can effectively reduce or eliminate stress. All these ways are inter related and bring about the maximum positive impact to deal with stress effectively.

            The first way is related to self awareness, self realization and acceptance of stress. These qualities build a foundation that will positively nurture the appropriate mindset and emotional attitude to deal with stress in realistic ways. The student must be aware, realize and accept the fact that he or she is experiencing stress. Such awareness, realization and acceptance are strong contributory factors to alert, motivate and initiate the student to think seriously of the nature, possible causes and potential consequences of the stress he or she is experiencing. The attention given to these issues is a strong catalyst to direct the student to want work out the solutions to deal with the problem or situation or people that generate the stress. Self awareness, self realization and self acceptance of stress will generate in students the need to confront stress with the right, positive, mental and emotional attitude.


       The second way that can help university students manage stress effectively is to educate and equip themselves with knowledge and relevant information on approaches, methods and techniques on how to identify the symptoms of various types of stress and stress related factors. For example, they can learn more about the causes and effects of stress on health, personality and lifestyle. Being university students, their maturity and mental and emotional intelligence should be their guides in searching for the above mentioned information from authorized sources like health reference books or the Internet. They can also seek advice from professionals namely doctors, lecturers and counselors or experienced individuals like parents and elders.The third way relates to a holistic healthy lifestyle that involves constant physical activity, having good eating habits, adopting positive attitudes to problems and nurturing healthy family, social and working relationships. These characteristics effects of stress like anxiety, frustration and health problems of poor concentration, lack of sleep and loss of appetite.

      In sum, I leave in shot note these three ways can effectively help university students to mange stress mentally, emotionally and holistically.

A social network service essentially consists of a representation of each user which known often as a profile, his or her social links, and a variety of additional services.



Most social network services are web based and provide means for users to interact over the internet, such as e-mail and instant messaging. Online community services are sometimes considered as a social network service. In a broader sense, social network service usually means an individual-centered service whereas online community services are group-centered. Social networking sites allow users to share ideas, activities, events, and interests within their individual networks.

 In the last five years, they have been growing up more and more popular. This increase in their popularity has led to a large number of members. One of the many reasons why Yahoo!, MySpace and Facebook social networking websites have increased in popularity is due to the fact that they cover a wide variety of different topics, issues and interest. They do not just focus on one particular group of individuals or one particular issue. Their policy is to invite as many types of internet users to join as possible. By this, it gives members a wide selection of online friends to choose from.

Kuala Lumpur International Airport (KLIA)

            Kuala Lumpur International Airport (KLIA) is one of Asia's major aviation hubs and is a destination in itself. It is located at the top of the southern corridor of Peninsular Malaysia, bordering the states of Selangor and Negeri Sembilan. It is situated in the Sepang district, approximately 50 km from the capital city, Kuala Lumpur. This RM 9 billion airport was opened by his majesty, the Yang Di-Pertuan Agong Tuanku Jaafar on June 27, 1998. The airport which covers 10 000 hectares of land took less than 5 years to build. It has a capacity to handle 25 million passengers and 1.2 million tonnes of cargo annually.

            Despite its mammoth size, it is user-friendly and as our former Prime Minister, Tun Dr. Mahathir Mohamad pointed out, it is not just an airport but a piece of art delicates to beauty as well as the environment. It is often described as the “airport in the forest, forest in the airport” because it is a futuristic structure set in rainforest landscaping. Lush tropical forests, with its diverse and exotic flora, skirt the entire airport structure.

            The control tower, standing at 130 metres, is one the tallest in the world. The colourful flora and the cascading waterfalls are part of spectacular and breathtaking sight which can be viewed from the Super View Corridor. Moving through the airport complex provides the visitor with glimpses of different forest – highlands, swamp, bamboo and multicoloured flora.

            The five-level Main Terminal building which is 241 000 squares metres, is located right at the heart of the airport complex. The building with its futuristic design of glass and steel is both the entry and exit point of passengers. On the top of the building is the departure concourse, and other facilities such as foreign exchange counters and international telephone facilities.

LCCT Terminal and Control Tower
            The Satellite Building where passengers make connections to other international flights is linked to the Main International Building by an automated train shuttle. The Satellite Building houses lounges, prayers rooms, duty free shops and a 80-room hotel for transit passengers. The KLIA will be the country’s nucleus that will spearhead business and trade. It is expected to provide 30 000 jobs and reap economic benefits for the country. The successful completion of the airport well ahead of schedule reflects the ability of Malaysians to build a world-class airport that has become the pride of the country.





Do and Does





To make a question in English we are normally use Do or Does. It is normally put at the beginning of the question.

Affirmative: You speak Arabic.
Question: Do you speak Arabic?

You will see that we add DO at the beginning of the affirmative sentence to make it a question. We use Dowhen the subject is Iyouwe or they.

Affirmative: He speaks Spanish.
Question: Does he speak Spanish?

When the subject is heshe or it, we add DOES at the beginning to make the affirmative sentence a question. Notice that the letter S at the end of the verb in the affirmative sentence (because it is in third person) disappears in the question. We will see the reason why below.

We DON'T use Do or Does in questions that have the verb To Be or Modal Verbs (can, must, might, should etc.)


Word Order of Questions with Do and Does

The following is the word order to construct a basic question in English using Do or Does.

*Verb: The verb that goes here is the base form of the infinitive = The infinitive without TO before the verb. Instead of the infinitive To have it is just the have part.

Remember that the infinitive is the verb before it is changed and it begins with TO. For example: to have, to eat, to go, to live, to jump etc.
